Can someone challenge my will after I die?
Transcript
It’s very difficult to challenge a will in court, especially if it’s been prepared by an attorney. There’s only really three arguments that you can use to challenge a will. One is that the person was not of sound mind when they signed it. Number two is that it was signed improperly, you didn’t have all the proper witnesses or notary on the documents, or number three, that the person who signed the will was under undue influence at the time. All three of those are very hard to prove. It’s very unusual to see a successful will challenge. But the bottom line is, anybody can file a claim and you do have to resolve it with a judge. But hopefully, you should not have a problem overcoming those especially if it was prepared by an attorney.
